Na sequência da aprovação do Decreto n.º 125/XIV, pela Assembleia da República, no dia 25 de Março do corrente ano, a qual determinou o levantamento da suspensão dos prazos processuais, com efeitos a 6 de Abril de 2021, o CSM considera oportuno informar que não obstante os constrangimentos decorrentes da pandemia provocada pela doença Covid-19 e as limitações resultantes das várias suspensões legais de prazos, os Tribunais foram capazes de continuar a dar uma resposta cabal e eficiente, como demonstra a análise das pendências e do número de diligências realizadas e adiadas, antes e após a suspensão dos prazos em 2020 e 2021.

Por determinação de Sua Excelência o Senhor Vice-Presidente do CSM leva-se ao conhecimento de Vossas Excelências que a Lei n.º 1-A/2020, de 19 de Março, que estabelece medidas excecionais e temporárias de resposta à situação epidemiológica provocada pela doença COVID-19, foi objeto da última alteração operada pela Lei n.º 4-B/2021, de 01 de fevereiro, que hoje entra em vigor, a qual aditou os artigos 6.º-B e 6.º-C que regulam prazos e diligências processuais, no âmbito dos processos e procedimentos que corram termos, entre outros, nos tribunais judiciais.

Sendo que, as orientações referidas no artigo 6.º-B, n.º 7, al. b) e n.º 9 da referida Lei n.º 1-A/2020, de 19 de março, são as que resultam das Medidas para Reduzir o Risco de Transmissão do Vírus nos Tribunais, elaboradas pelo CSM, CSTAF, PGR, DGAJ e DGS, expressas na divulgação n.º 124/2020, de 07/05/2020, deste CSM, que se anexa.

Mantém igualmente atualidade o que resulta dos planos de contingência dos tribunais de 1ª. instância (Divulgação n.º 59/2020, de 04/03/2020) e sempre que se mostrar necessário, o plano de contingência específico de cada Comarca, elaborado pelos Exmos. Senhores Presidentes de Comarca.

Por determinação de Sua Excelência o Senhor Vice­-Presidente do CSM leva- ­se ao conhecimento de Vossas Excelências o seguinte:

O Conselho Superior da Magistratura está a trabalhar com o Ministério da Justiça na definição dos critérios de vacinação dos Senhores Magistrados Judiciais contra a doença COVID-­19 e ainda não obteve a informação concreta quanto ao número de juízes que será possível vacinar nesta fase, nem quanto ao momento em que concretamente se iniciará a vacinação.

Na proposta de critérios orientadores solicitada ao CSM, este manifestou a intenção que, na impossibilidade de proceder à vacinação de todos os Senhores Juízes numa primeira fase, a prioridade deve ser dada aos juízes com maior risco de exposição a contágios decorrente do exercício da função e não com base em critérios gerais de idade e saúde, que devem ser atendidos nas fases gerais de vacinação da população em geral.

Por determinação de Sua Excelência o Senhor Vice­-Presidente do CSM leva-­se ao conhecimento de Vossas Excelências o seguinte:

Considerando as crescentes dúvidas suscitadas relativamente à atividade dos tribunais, uma vez que se aguarda que seja aprovada e publicada a respetiva legislação pela Assembleia da República, na sequência da proposta de lei a que alude o Comunicado do Conselho de Ministros de 21 de janeiro de 2021, o CSM esclarece, tal como o fez através da divulgação n.º 67/2020, de 11/03/2020, a qual mantém plena atualidade, que todas as decisões relativas a adiamento de diligências processuais agendadas integram-­se no âmbito da competência funcional dos Senhores Magistrados Judiciais, encontrando-­se por isso, integradas no exercício das funções jurisdicionais, relativamente às quais não incumbe a este CSM autorizar.

Sendo que, a realização de diligências processuais deverá ocorrer com respeito pelas condições sanitárias, designadamente as que resultam das “Medidas para Reduzir o Risco de Transmissão do Vírus nos Tribunais”, expressas na divulgação n.º 124/2020 de 07/05/2020.

«Foi aprovada, ainda, uma proposta de lei, a submeter à Assembleia da República, que aprova um conjunto de medidas relativas à suspensão de prazos para a prática de atos processuais e procedimentais que devam ser praticados no âmbito dos processos e procedimentos que corram termos nos tribunais judiciais, tribunais administrativos e fiscais, Tribunal Constitucional, Tribunal de Contas e demais órgãos jurisdicionais, tribunais arbitrais, Ministério Público, julgados de paz, entidades de resolução alternativa de litígios e órgãos de execução fiscal».

O CSM aguarda que seja aprovada e publicada a mencionada proposta de lei, pela Assembleia da República, a fim de tomar as medidas tidas por convenientes, as quais serão imediatamente divulgadas.

Juízes reuniram-se no Porto, no encontro de final de ano do Conselho Superior da Magistratura

Na manhã de trabalho de final do ano do Conselho Superior da Magistratura (CSM), que decorreu hoje no Porto, foi reiterada a conclusão de que, mesmo com as contingências impostas pelo estado de emergência e com o regime de suspensão dos prazos determinado pelo Governo, foram concluídos entre abril e maio deste ano o total de 181.977 processos, mais 6.849 do que os entrados no mesmo período.

Estes dados permitem concluir que, apesar das restrições impostas pelo estado de emergência, circunstâncias totalmente alheias aos juízes, a atividade judicial nunca esteve suspensa.

No último balanço feito, a 20 de Maio de 2020, registavam-se 1.285 mandados de libertação emitidos pelos Tribunais de Execução de Penas no âmbito da Lei n.º 9/2020 sobre o regime de flexibilização da execução de penas e das medidas de graça por causa da Covid 19.

Até ao dia 4 de Junho registaram-se mais 11 mandados de libertação distribuídos da seguinte forma: no dia 1 de Junho, cinco (5), em Lisboa, e dois (2), em Évora. No dia 2 de Junho, quatro (4) em Lisboa.

O total de mandados de libertação a 4 de Junho é, assim, de 1.296.
